Summary: Vergine’s account of the formative years of performance art takes stock of the many innovative strategies artists developed for re-engaging the human body. One of the crucial dimensions of this reengagement is the positioning of one’s body in physical proximity with others. This happens in art through the bodily negotiation of basic dichotomies such as nature/artifice, ethos/pathos, agency/abandon, publicity/privacy, mortality/immortality etc. Vergine sees objects, and the body’s undifferentiated objecthood, as active participants in the performative communication and communion between artist and audience. These forms of togetherness stand or fall on the intensity of all parties’ affective investment, but they are also equally affected by the level of intellectual mutuality an art work occasions. According to Vergine, the demand for intelligent analysis and deep understanding that performance art places on its audience is balanced out by the artists’ bodily presence. For her the artist’s body does not serve merely as a mechanical expedient. It also “contributes to the life of consciousness and memory in a psycho-physical parallelism of processes that assume meaning and relief only when they are connected.”
The Art of Ideas and the Media Generation
Summary: In this brief historical note, Goldberg outlines the artistic response to the political upheavals of the 1960’s. The general spirit of civic disillusionment offered the best conditions for the re-evaluation of art and its supporting social institutions. Not surprisingly, a new animosity emerged towards the objects of art and their claim to aesthetic pleasure. The farthest possible opposite, which many artists readily embraced, was found in conceptual art, which prioritized ideas, relations and experiences over traditional aesthetic categories. Goldberg sees performance art as a potent embodied application of these new artistic concerns, and thus as a rightful heir to conceptual art. Furthermore, each sub-genre of performance art – from body art to live sculpture to discussions and performative scripts – retains a conceptual core that finds its roots in that decade of strife and controversy.

Summary: Korsmeyer argues that although genuineness (or authenticity) is not a perceptual property, it is still an aesthetically relevant property for cultural artifacts, an argument that she locates in the relationship between age and the sense of touch. Summary: In this short selection, Keeshig-Tobias (Ojibway) raises questions about representation and authenticity in fiction about Native people written by non-Native authors. With reference to certain Native belief systems, she contextualizes why the telling of a story could be viewed as theft in a way that might seem counter-intuitive to a liberal Western audience.
Whose Culture Is It, Anyway?
Summary: In this chapter, Appiah offers a cosmopolitan critique of the concept of cultural property/patrimony. By emphasizing the common features of our humanity and the tenuousness of certain cultural identity claims, he puts pressure on conceptions of cultural property that would exclude others, particularly those that have a nationalist character. He raises important philosophical questions about cultural continuity over time, and explores how the location of art can best facilitate its value for humanity. In general, he supports a cosmopolitan/internationalist approach to cultural property that promotes the exchange of cultural products around the world.
A Philosophical Perspective on the Ethics and Resolution of Cultural Property Issues
Summary: Warren’s chapter offers a careful and systematic look at arguments concerning what she calls “the 3 R’s”: restitution (or repatriation) of cultural property, restrictions on cultural imports and exports, and the rights (to ownership, access, etc.) over cultural property. She ultimately argues that this framework should be overturned in favor of an approach to cultural property disputes that is modeled on conflict resolution. This approach deprioritizes traditional talk of property and ownership in favor of a focus on preservation.

Summary: In this paper, Thompson approaches questions about the repatriation of art and artifacts through the lens of cultural property. She briefly discusses the nature of cultural property itself, and then moves on to exploring how her preferred conception of cultural property (roughly, culturally significant objects that are legitimately acquired by a collectivity) can facilitate or hinder claims for repatriation. In particular, she discusses the relationship between cultural property-based claims and potentially countervailing considerations, such as the purported universal value (or “value for humanity”) of cultural heritage.

Saving Unobservable Phenomena
Abstract: In this paper the author argues -against van Fraassen’s constructive empiricism-that the practice of saving phenomena is much broader than usually thought, and includes unobservable phenomena as well as observable ones. Her argument turns on the distinction between data and phenomena: She discusses how unobservable phenomena manifest themselves in data models and how theoretical models able to save them are chosen. She presents a paradigmatic case study taken from the history of particle physics to illustrate her argument. The first aim of this paper is to draw attention to the experimental practice of saving unobservable phenomena, which philosophers have overlooked for too long. The second aim is to explore some far-reaching implications this practice may have for the debate on scientific realism and constructive empiricism.
