Radin, Joanna. Digital Natives’: How Medical and Indigenous Histories Matter for Big Data

Abstract: This case considers the politics of reuse in the realm of “Big Data.” It focuses on the history of a particular collection of data, extracted and digitized from patient records made in the course of a longitudinal epidemiological study involving Indigenous members of the Gila River Indian Community Reservation in the American Southwest. The creation and circulation of the Pima Indian Diabetes Dataset (PIDD) demonstrates the value of medical and Indigenous histories to the study of Big Data. By adapting the concept of the “digital native” itself for reuse, I argue that the history of the PIDD reveals how data becomes alienated from persons even as it reproduces complex social realities of the circumstances of its origin. In doing so, this history highlights otherwise obscured matters of ethics and politics that are relevant to communities who identify as Indigenous as well as those who do not.
Comment (from this Blueprint): In this 2017 paper, historian Joanna Radin explores how reusing big data can contribute to the continued subjugation of Akimel O’odham, who live in the southewestern region of the US, otherwise known as the "Pima". This reading also illustrates how data can, over time, become used for what it was never intended or collected for. Radin emphasizes the dangers of forgetting that data represent human beings.

Abstract: There are some long-standing social issues that imperil Black Americans' relationship with health and healthcare. These issues include racial disparities in health outcomes (Barr 2014), provider bias and racism lessening their access to quality care (Sabin et al. 2009), disproportionate police killings (DeGue, Fowler, and Calkins 2016), and white supremacy and racism which encourage poor health (Williams and Mohammed 2013). Bioethics, comprised of humanities, legal, science, and medical scholars committed to ethical reasoning is prima facie well suited to address these problems and influence solutions in the form of policy and education. Bioethics, however, so far has shown only a minimal commitment to Black racial justice.
Comment (from this Blueprint): In this short, seminal piece, Keisha Ray argues that bioethics needs to address issues of health and well-being of Black individuals. She applies Beauchamp and Childress’s famous four principles of bioethics to a particular issue: the disproportionate maternal mortality rate of Black women in the United States. Ray argues bioethics must incorporate the lens of Black bioethics, if the discipline is to remain relevant.

Abstract:

A threat to women is obscured when we treat “abortion-as-evacuation” as equivalent to “abortion-as-killing.” This holds only if evacuating a fetus kills it. As technology advances, the equivalence will fail. Any feminist account of abortion that relies on the equivalence leaves moral room for women to be required to give up their fetuses to others when it fails. So an account of the justification of abortion-as-killing is needed that does not depend on the equivalence.

Comment: This text explores a common justification for the permissability of abortion, which the author describes as an equivalence between "abortion-as-killing" and "abortion-as-evacuation". The author also examines a series of dilemmas which arise from traditional pro-choice discussions of abortion (at least at the time of writing), such the two-horned dilemma which appears to trap pro-choice advocates in only two camps: one in which the fetus is morally signficant (and therefore can only be aborted, but not killed), and another in which the fetus is morally negligible (in which case, it does not matter). Reader challenges this dichotomy and aims to show that fetal killing can be justified without claiming that fetuses are negligible by focusing on relationship, in general, and motherhood, in particular. Therefore, the text would be most useful as a primary or supplemental reading in an intermediate or advanced course studying contemporary analytic debates on abortion or feminist thought and critical gender studies.

Abstract:

How can we justify partiality to those near to us, such as our own families, friends, neighbours and colleagues, when we could act in much more morally valuable ways by helping others who are merely distant from us? In 1972 Peter Singer used two now-famous examples, Pond and Overseas, to challenge our complacent partiality. The charge of neglect of an obvious moral duty to meet distant grave needs is refined and developed by Peter Unger(1996).

Although Singer is a consequentialist, he intends the problem of distance to challenge all moral thinkers irrespective of their theoretical commitments. Singer's challenge has somehow to be met, and this is what discussions of the problem of distance in contemporary analytic philosophy attempt to do. To solve the problem, we have to reject
or modify impartialism or partialism.

Comment: This paper addresses the problem of moral obligation in relation to distance famously introduced by Peter Singer in his paradigmatic cases of Pond and Overseas (1972), by considered attempted solutions and proposing a new, relationship-based account which accomodates both impartialist and partialist intuitions about moral obligation. The arguments contained in this paper pre-empt some of Reader's later work on a needs-based moral theory. As such, the text could be used in a few different ways. It could be paired with some of Reader's later works to examine and discuss alternative moral theories to the traditional canon of consequentialism, deontology, and virtue ethics. Or it could be used in an introductory moral and political philosophy course as a supplemental text / further reading to Singer's original 'Famine, Affluence, and Morality', as a way to discuss how other authors have challenged Singer's position.

Abstract: I argue that lying is generally morally better than mere deliberate misleading because the latter involves the exploitation of a greater trust and more seriously abuses our willingness to fulfil epistemic and moral obligations to others. Whereas the liar relies on our figuring out and accepting only what is asserted, the mere deliberate misleader depends on our actively inferring meaning beyond what is said in the form of conversational implicatures as well. When others’ epistemic and moral obligations are determined by standard assumptions of communicative cooperation and no compelling moral reason justifies mere deliberate misleading instead, one had better lie.
Comment: This text works particularly well when used together with Jennifer Saul's "Just go ahead and lie" (2012).

Introduction: The nonidentity problem focuses on the obligations we think we have in respect of people who, by our own acts, are caused both to exist and to have existences that are, though worth having, unavoidably flawed – existences, that is, that are flawed if those people are ever to have them at all. If a person’s existence is unavoidably flawed, then the agent’s only alternatives to bringing that person into the flawed existence are to bring no one into existence at all or to bring a different person – a nonidentical but better off person – into existence in place of the person whose existence is flawed. If the existence is worth having and no one else’s interests are at stake, it is unclear on what ground morality would insist that the choice to bring the one person into the flawed existence is morally wrong. And yet at the same time – as we shall see – it seems that in some cases that choice clearly is morally wrong. The nonidentity problem is the problem of resolving this apparent paradox. The problem raises the question whether the (usually significant) good that an agent confers along with existence counterbalances the (usually limited) bad that an agent confers along with any unavoidably flawed existence in such a way that our existence-inducing act (usually) will be deemed permissible. And if it isn’t – if we think instead that obligations are left unsatisfied despite the good that comes with existence – is the moral of the story that moral obligation extends beyond what we must do for people? If we agree, in other words, that it is our obligation to create additional good, is it enough that we create additional good for each and every existing and future person? Or does the nonidentity problem show that our focus should instead be on creating additional good for the universe? As we query how to evaluate existence-inducing acts for their moral permissibility – as well as outcomes or possible futures or worlds, for their moral betterness against still other worlds – we find that some of our most deeply held intuitions regarding the nature and structure of morality are thrown into doubt.
Comment: This text offers a comprehensive introduction to the nonidentity problem and lists several illustrative thought experiments and examples used in the literature. It is a very helpful introductory or further reading for any topic which touches on the nonidentity problem.

Summary: This paper develops the claim that indefinite detention (as used by the U.S. following the attacks on September 11, 2001) is justfied by an appeal to racialized fear. Roberts argues that the indefinite detention of suspected terrorists is both immoral and unjust--claiming that arguments in favor of it (such as the interest in interrogation, the consequentialist justification, and the preventative detention argument) fail to ground the permissibility of indefinite detention.
Comment: This text would be of use in a course discussing the ethics of war, criminal justice ethics, or the idea of terrorism. It presents a clear discussion, in an accessible way, of a number of arguments in favor of indefinite detention, ultimately arguing that such defenses are insufficient to ground its moral permissibility.

Abstract: My aim in this essay is to remove some of the rubbish that lies in the way of an appropriate understanding of rectificatory compensation, by arguing for the rejection of the counterfactual conception of compensation. Although there is a significant extent to which contemporary theorists have relied upon this idea, the counterfactual conception of compensation is merely a popular assumption, having no positive argument in support of it. Moreover, it can make rendering compensation impossible, and absurd notions of compensation can result from its use, results that may themselves constitute injustices. This latter difficulty is most troubling when the CCC is employed in large compensatory cases like the case of rectificatory compensation for the descendants of American slaves. I want to suggest that, taken together, the difficulties with the CCC yield sufficient reason for rejecting it as an acceptable rectificatory notion.
Comment: This text presents an interesting and accessible discussion of the counterfactual conception of compensation (most famously presented by Nozick, though one need not have read Nozick to understand this text) as a matter of rectificatory justice. It would be of use in courses concerning schemes or principles of distributive and rectificatory justice. As the text analyzes the justification for reparations to the decendents of African slaves in the U.S., it would also be of use in a course that covers questions of reparations for historical injustices (perhaps alongside Coates' well known "The Case for Reparations").

Abstract:

This article addresses the question whether a basic income will be a just social policy for women. The implementation of a basic income will have different effects for different groups of women, some of them clearly positive, some of them negative. The real issues that concern feminist critics of a basic income are the gender-related constraints on choices and the current gender division of labour, which are arguably both playing at the disadvantage of women. It is argued that those issues are not adequately addressed by a basic income proposal alone, and therefore basic income has to be part of a larger packet of social policy measures if it wants to maximise real freedom for all.

Comment: This paper explores questions as the intersection of feminism and the basic income literature, offering a take on one of the classic feminist critiques of basic income: namely, that the purported conditions of freedom that basic income is supposed to bring about are only really available to members of the population who do not belong to an oppressed or marginalised class. For those that do belong to such groups - in this case, women - the availability of such conditions of freedom will be highly dependent on existing gendered divisions of labour and restrictions on choice. As such, the author argues that proposals for basic income, if they are serious about ensuring real freedom for all, must take this into consideration. The author also challenges existing (at the time of writing) contradictions in the claims being made about the effect of basic income policy on women, as opposed to men. The paper would therefore be interesting to discuss in relation to feminist politics or a survey of the basic income literature, especially assigned in tandem with some of the foundational literature, such as Phillipe Van Parijs' work.

Abstract: This paper examines the morality of kidney markets through the lens of choice, inequality, and weak agency looking at the case for limiting such markets under both non-ideal and ideal circumstances. Regulating markets can go some way to addressing the problems of inequality and weak agency. The choice issue is different and this paper shows that the choice for some to sell their kidneys can have external effects on those who do not want to do so, constraining the options that are now open to them. I believe that this is the strongest argument against such markets.

Comment: A self-contained argument that introduces key concepts in philosophy of economics namely, liberty, externality, choice and markets, through the example of kidneys.

Abstract: The view that lying is morally worse than merely misleading is a very natural one, which has had many prominent defenders. Nonetheless, here I will argue that it is misguided: holding all else fixed, acts of mere misleading are not morally preferable to acts of lying, and successful lying is not morally worse than merely deliberately misleading. In fact, except in certain very special contexts, I will suggest that – when faced with a felt need to deceive – we might as well just go ahead and lie.
Comment: This text can be used to inspire a discussion on general ethical issues and the practical application of moral theories. It is particularly useful in teaching applied professional ethics. It works well when used together with Clea F. Rees' "Better Lie!"
